Why Does Prohibition of Discrimination Fail to be Fully Observed——On Observation of Legal Sociology About Factors Against the Implementation of Anti-discrimination Laws

Abstract: Law is an important means against discrimination. However, even under the same legal environment, different discrimination will reflect differently—atrophy or boycott, which suggests that other factors are affecting the regulatory effect. This complex situation is the combined result of many factors, such as the difference protest will and aspirations of discriminated groups, the shelter provided by stereotype and other mass psychology, the instigation of economic rationality as well as implicit/explicit characteristics of the necessary identity information that discrimination against. Non-legal factors' influence on the implementation of anti-discrimination laws shows that comprehensive measures should be taken to eliminate discrimination. It is necessary to rely on laws to regulate behavious, also to understand the social ecological environment in which the discrimination generate and develop. We must take multiple methods of economy, psychology, society, to solve the problem completely and establish a fair society.
